Judicial Review

In any democratic society it is important that state bodies are held to account. Judicial review is a remedy where a decision by an administrative body of the state is examined by the High Court and can be overturned. It is a way for the High Court to “supervise” the lower courts and administrative bodies to make sure that decisions are made properly.

The High Court will look at how the court or body made the decision rather than what the decision was. If a person has an issue with what the decision was then the best remedy is an appeal.
